Bequest Language
The information presented here is not offered as legal or tax advice. You should seek the advice of your tax advisor, attorney and/or financial planner to make certain any gift or bequest you are considering fits well with your individual circumstances. We have provided some basic bequest language to assist you and your advisor.
If you are considering making an outright bequest to the Alabama Holocaust Education Center, we recommend the following language:
Bequest of a Specific Dollar Amount
“I hereby give, devise and bequeath the sum of $ DOLLARS to the Alabama Holocaust Education Center, Inc.; a nonprofit organization located at 2100 Highland Avenue South Suite 101 Birmingham, AL 35205, Federal Tax ID #80-0955027, for the Alabama Holocaust Education Center, Inc.’s general use and purpose.”
- Avoid paying capital gains tax on the sale of appreciated stock
- Receive a charitable income tax deduction
These gifts can be made by:
- Electronic transfer – Please contact us at 205-803-1523 for instructions on how you can transfer stock or bonds from your brokerage or investment account to the Alabama Holocaust Education Center.
- By certified mail – If you hold securities in certificate form, you will need to mail two envelopes separately to complete your gift. In the first envelope, place the unsigned stock certificate(s). In the other envelope, include a signed stock power for each certificate. You may obtain this power from your broker or bank. Please remember to use certified mail.
There are special rules for valuing a gift of stock. The value of a charitable gift of stock is determined by taking the mean between the high and low stock price on the date of the gift. Mutual fund shares are valued using the closing price for the fund on the date of the gift.
If you have any questions about gifts of stocks and bonds, please call us at 205-803-1523 and we will be happy to assist you and answer any questions that you have.
If you are considering making a bequest of a percentage of your estate to the Alabama Holocaust Education Center, Inc., we recommend the following language:
“I hereby give, devise and bequeath percent ( %) of my total estate, determined as of the date of my death, to the Alabama Holocaust Education Center, Inc.; a nonprofit organization located at 2100 Highland Avenue South Suite 101 Birmingham, AL 35205, Federal Tax ID #80-0955027, for the Alabama Holocaust Education Center, Inc.’s general use and purpose.”
You may designate your bequest to support a specific program or purpose that reflects your personal or professional interest. For example, you may wish to make a bequest to the Teacher Workshops, the Taking Action Together program, Holocaust Film Series or any other program that is meaningful to you.
If you are making a restricted bequest, we recommend that your attorney include the following wording at the end of the provision to give the Alabama Holocaust Education Center flexibility should it no longer be possible for the Alabama Holocaust Education Center to use your gift as you originally intended.
“…for so long as the Alabama Holocaust Education Center Board of Directors determines that the need exists. Should the need no longer exist, said Board of Directors may, in its sole discretion, direct the use of my bequest for a purpose related as closely as possible to that stated above.”
Types of Bequests
In your last will and testament or trust, you may designate where the remainder of your estate will go after all other bequests, debts, and taxes have been paid. You can designate the Alabama Holocaust Education Center as beneficiary of all or a portion of your residual estate.
